User Notice

Ogyhi alone operates the Ogyhi™ Service (the "Ogyhi Service"). Your mobile operator, its affiliates and/or subsidiaries only provide the location data and phone transmission for data used by Ogyhi. Your mobile operator is not responsible for the Ogyhi Service, its content or operation; Ogyhi is responsible for the Ogyhi Service. The use of the Ogyhi Service to reveal your personal information and location is entirely at your own risk. Your mobile operator disclaims any responsibility when others post information, or get your personal information and locate you through the Ogyhi Service. Your mobile operator only provides the location data and phone transmission for data sent by Ogyhi, you and others. By using the Ogyhi Service: (a) you acknowledge that your mobile operator makes no warranties of any kind regarding the Ogyhi Service and expressly disclaims any implied warranties, including warranties of merchantability and fitness for a particular purpose; (b) you waive any claim you might otherwise have, and you agree not to bring any claim or complaint anywhere, against your mobile operator arising out of the operation or failure of the Ogyhi Service; (c) you agree that all other terms of your current subscriber agreement with your mobile operator apply to the Ogyhi Service insofar as your mobile operator provides the location data to enable and the phone connection to transmit the Ogyhi Service; (d) you agree that except as noted in Point c immediately above, operation and use of the Ogyhi Service are governed by the Ogyhi Privacy Policy which alone will apply to the Ogyhi Service; and (e) you agree to indemnify your mobile operator against any claims, losses, or damages arising out of your use of the Ogyhi Service.

In addition to the above, you agree: (a) to be located, and consent to have your mobile operator release your location data as it pertains to the Ogyhi Service and (b) the location service accuracy can vary depending on the users situation (i.e. in rural vs. urban areas) and (c) the service provider has the right to terminate the service at any time without prior notice at their sole discretion.

Location Information Notice

Ogyhi Service is capable of allowing others to know where you are located using real-time location information. To provide this aspect of the Ogyhi Service, Ogyhi collects, uses and discloses your personal data and the real-time geographic location of your cell phone or other mobile device - we call this "location data". Please note that this location tracking may occur even when the Ogyhi Service is not actively running on your cell phone or other mobile device. By providing your consent, you authorize Ogyhi and your mobile operator to collect, access, use and disclose the geographic location information of your carrier device and other personal and account information (i.e. name, address, telephone number, account number, equipment identifiers, Internet Protocol addresses, etc.) to certain third parties in order to enable the delivery and administration of your selected LBS application; including the functions that are incidental and necessary to such delivery (i.e. invoicing, etc.). You also expressly authorize Ogyhi to collect and use this location data and to disclose this location data to Ogyhi contractors, and certain third-party partners that provide features and functionality within or distribution of the Ogyhi Service and to any persons that you choose to accept and consent to view and use your location through. At any time, you may approve or deny a particular person from access to your location by changing your Ogyhi Service privacy settings. You have the right at any time to reject these uses of your location data and to deny or withdraw your consent; denial of consent will not affect your regular mobile phone service, but will prevent you from using Ogyhi Service. To stop sharing your location entirely at any time or withdraw your consent to Ogyhi use of location data - send "STOP" to 02031372222 or do so at www.ogyhi.com. Furthermore, by providing your consent, you (1) acknowledge that your consent serves as consent on behalf of all persons who use your carrier device ("End Users"); (2) acknowledge that you are responsible for notifying each End User that their geographic location information may be identified through your carrier device using the Ogyhi Service; and (3) agree that you will clearly, conspicuously, and regularly notify in writing all End Users that their location may be identified through your carrier device using the Ogyhi Service.
